Why Was Davis High School Fined $15,000

OK. Reading this headline got me excited mainly due to curiosity and then outraged because I really do care about the education system in the United States. What could have this school done? What laws did they break that caused a 15,000 fine? Were drugs being sold in the school? Did another teacher have a sexual relationship with a student? Was the principal or teachers in the school turning a blind eye to some kind of corruption or possibly involved themselves in some sinister plot?

At first glance, I thought maybe the $15,000 fine was due to the useless AIMS testing that school administrators fear and maybe tried to bump up their scores for David High School to continue to receive allocated government funding. All of my guesses were wrong; very wrong.

The school was fined by the “Health Police” AKA “The Obesity Police” another government run plan that is for our own good controlling a matter that they have no business regulating and that matter in the case was a soda machine. Yes an evil soda machine.

Can you believe it?

With the economy, school cut backs, a lack of great teachers across the country, low teacher pay and students that for the most part are apathetic towards learning; this is where school money, the tax dollars for Davis High School are going.

It was not to surprising to find out that it is against Federal Law for soda pop to be sold during lunch hour. The Federal mandated law prohibits the sale of soda and/or carbonated beverages after lunch hours. The federally mandated program — sorry I mean law — is a benevolent effort by Big Brother to wage a war against childhood obesity, which is supposed to “help” students make better choices. If you want students — which is what belongs to the government — to make better “choices” then maybe allow the government run students to be citizens, who are educated by their parents.

Has the family failed completely? If so, then does that warrant this government intervention? Talk about a complete misdirect on war in general by the Left in the this case against childhood obesity, which seems to be a preemptive strike. I thought for a war to be just that it needed a first attack against American citizens. In this case, preemptive strikes to save the lives of uneducated students who cannot think for themselves in the education system is OK. I hope you find this as ironic as I do and see that this utilitarian move by the US government is not just.

All students are not the same.

The idea in science called uniformity is false when it comes to human beings and not matter what we take away from some to redistribute to others we will be equal. This has nothing to with race, it is just a fact that I do not have the talent or height to play in the NBA. We are all equal under God, the constitution, race, creed or religion, but we are not equal in talent or in our DNA code meaning that all people are not doomed to the murderous dictator of obesity; which just in case you are not keeping up with the news is not a country harboring terrorist in the Middle East.

I know we have major health problem in the US and I know how high school students think, but this is completely absurd. David High School actually had the lunch room soda machines turned off in the lunch room, but forget one machine in the book store. That is what the caused the fine. Education that also teaches moderation is the best kind of education a student or rather citizen can receive when it comes to making life decisions or choices regarding there health or future.

For more clarity here are some interesting quotes regarding the matter of when it is safe to use a soda machine.

“Before lunch you can come and buy a carbonated beverage. You can take it into the cafeteria and eat your lunch, but you can’t first go buy school lunch then come out in the hallway and buy a drink,” said Davis High Principal Dee Burton.

Principal Burton said he does not understand the law with rules that seem to be contradictory.

“We can sell a Snickers bar, but can’t sell licorice. We can’t sell Swedish Fish, we can’t sell Starburst, we can’t sell Skittles, but we can sell ice cream, we can sell the Snickers bar, Milky Ways, all that stuff,” said Burton.


The school is bound to obey the law, however, if they want the $15,000 the federal government gives to subsidize their school lunch program.


Burton said the money they will use to pay the fine was typically used to help pay for their music and arts department among other school activities.


Burton said his pop machines will continue to stay completely unplugged until they can figure out how to get them all into a room with a door that can be shut and locked during the lunch hour.

Will you? Because I think blaming Reagan for the obesity problem in a little far fetched.
